Chris Lam Obtains Total Defense Verdict on Behalf of Client 3D Systems Corporation

After two weeks of trial in federal court in Honolulu, Chris Lam, a partner at Bradley Arant Boult Cummings, LLP, and co-counsel from Nexsen Pruet, LLC and Goodsill Anderson Quinn & Stifel, including fellow IADC member Dawn Sugihara, obtained a total defense verdict on behalf of client 3D Systems Corporation. The jury deliberated less than two hours and also found in 3D Systems' favor on its counterclaim that Plaintiff violated his non-compete. The case arose out of 3D Systems' purchase of two web domains and instant online quoting engines for 3-D parts from Plaintiff in 2011. In 2013, Plaintiff filed suit against 3D Systems and its former CEO and CFO, alleging seven claims. Following a partial grant of summary judgment in favor of 3D Systems and the individual executive defendants, the only remaining claims for trial were against the company for breach of contract, breach of the implied covenant of good faith and fair dealing, and unjust enrichment. Plaintiff claimed 3D Systems breached a promise to commit “substantial resources” to the domains post-acquisition, resulting in a lower than expected buy out under the contract. As a result of the verdict, 3D Systems will be entitled to consideration of an attorneys’ fees award and an accounting of Plaintiff’s breach of the non-compete provision.
