Defending EEOC Subpoena Enforcement Actions: Nuts and Bolts
It’s the kind of mail most clients do not want—notification that the EEOC plans on issuing a subpoena to obtain documents from the respondent company as part of its investigation into a charge of discrimination. Karen Glickstein and Larry Smith will discuss just how “absolute” the subpoena power of the EEOC is, how common it is for the agency to use its subpoena power and if any patterns can be discerned as to which types of cases are most likely to be subject to a subpoena. The presenters will also discuss how best to respond to subpoenas in order to present the company in the best common light and whether and when objections may be made and sustained by the courts.
