Kate Skagerberg and Paul Rosenblatt
IADC members Kate Skagerberg at Nelson Mullins Riley & Scarborough LLP and Paul Rosenblatt at Butler Snow LLP secured a complete defense jury verdict in a two week Johnson & Johnson pelvic mesh trial in Texas federal court.
On October 13, 2022, a federal jury rejected plaintiff’s claims related to the TVT-O pelvic mesh device. TVT-O is manufactured by Ethicon, Inc., a subsidiary of Johnson & Johnson.
The Plaintiff, a woman implanted with TVT-O, alleged that she suffered permanent injuries from this device, including mesh erosion, pain with sex, chronic pelvic pain, pudendal neuralgia, and obturator neuralgia. In closing argument, plaintiff’s counsel requested millions of dollars to compensate plaintiff. The jury deliberated for less than an hour before returning with a complete defense verdict, finding that the device was not defectively designed and that the warnings didn't conceal potential dangers.
