Companies in the Crosshairs: When Criminal Offenses and Civil Liability Intersect

The rapid growth in legislation imposing criminal penalties on corporations is a concern for GCs
everywhere.
It’s 9pm and you receive a call from The Guardian that your company is going to be front page news tomorrow. The editor says it is in the public interest for the bribery allegations about your dealings with your international resellers to be publicly aired; and it is an open secret that the Serious Fraud Office is going to lay criminal charges imminently. What do you do?

In this session we will explore:

  • Does your company co-operate with the SFO – or not?
  • And what about other regulators with an interest – how should they be dealt with?
  • Several employees are in the crosshairs too: does your company pay their legal fees in defending themselves from the charges? And leave them in post meanwhile, or suspend them, pending the conclusion of investigations?
  • What works in mitigation of any decision to prosecute, and what doesn’t? Is a voluntary redress scheme for affected individuals a good thing for the company proactively to pursue?

Moderator: Marc Dautlich, Bristows LLP, London, United Kingdom
Speakers: Matthew Barton, General Counsel, ZIGUP, Ashby St Ledgers, United Kingdom; Peter Binning, Corker Binning, London, United Kingdom; Alexander de Swart, Wladimiroff Advocaten, The Hague, Netherlands

If I Knew Then….An In-House Perspective on the Practice of Law in 2025 and Training Up a New Generation of Lawyers

The practice of law has changed significantly over the years, particularly with the advances of technology and globalization. At the same time, the more some things have changed the more others have stayed the same. Our panel of esteemed in-house counsel will re-visit their younger selves before they went to law school and consider the advice they would have given to themselves knowing now what they did not know then. They will also ponder how we train up the next generation of lawyers to continue to support the rule of law in today’s world, as well as the particular challenges facing in-house counsel and those they see outside counsel facing.
