Charles Cole Obtains Defense Verdict in a Complex Medical Negligence Case

Charles Cole of Schuyler, Roche & Crisham was successful in obtaining a defense verdict for a physician in a complex medical negligence case on January 17, 2013. The trial was conducted over two weeks in Whiteside County, Illinois, a rural venue about 120 miles west of Chicago. The case involved allegations that a physician's negligence resulted in the death of a 58 year old man, survived by his wife and two adult children, due to the physician's failure to suspect and diagnose a myocardial infraction. The case was complicated by the patient's presentation without any classic sign or symptoms of a heart attack but with complaints of upper back pain, a highly uncommon presentation of a heart attack without more symptoms. The jury deliberated for about 90 minutes. Mr. Cole was assisted by his senior associate, Margaret Fitzsimmons.
