Charles Cole Obtains Sucessful Verdict in a Complex Obstetrical Medical Negligence Case

IADC member and current Director of the IADC Trial Academy, Charles Cole of Schuyler, Roche & Crisham of Chicago, was successful in obtaining a directed verdict on April 26, 2013 for a physician after one week of trial in a complex obstetrical medical negligence case. The case involved allegations that the defendant obstetrician issued induction of labor orders for a woman expected to deliver a large baby who was also past her due date. The defendant obstetrician then assumed that another physician was actually covering the birth. That second physician arrived late and was faced with a vaginal delivery that resulted in a shoulder dystocia and a produced a severe brachial plexus injury. The directed verdict was obtained when Mr. Cole convinced the court that plaintiff's attorney failed to offer necessary proof that the defendant failed to meet any standard of care relating to a need for a caesarian section or that a caesarian section would have changed the outcome.
