Active IADC member and former DRI board member Christopher A. Kenney, a partner at Kenney & Sams, P.C., along with Adam C. Ponte, recently achieved a defense verdict in Massachusetts Superior Court when a jury returned a defense verdict for their client, an industry-leading national restaurant chain.
The jury rejected the plaintiff’s claim that the restaurant’s floor tile was defectively manufactured and posed a safety hazard. Attorney Kenney presented an expert engineering witness who tested the co-efficient of friction of the floor tile and testified that it exceeded industry standard for slip resistance. He also rebutted the Plaintiff’s damages by showing that her alleged back injury was caused by previous, unrelated accidents.
