Courtroom Success: Monica Frois and Eve Masinter

The legal team Pediatric Services of America (“PSA”), Monica A. Frois of Baker Donelson and Eve B. Masinter of Lemle & Kelleher, L.L.P., received a judgment in favor of their client. After a six week long trial in the 15th Judicial District Court for the Parish of Lafayette, State of Louisiana, a jury returned a zero verdict for the Plaintiffs. Camille and Ryan Landry, individually and on behalf of their minor child, Tai Landry, filed suit against PSA, Vasanth Nalam, M.D., Rosaire Belizaire, M.D., Cong Thanh Vo, M.D., Maria Teresa Messina-Doucet, M.D., Kenneth Wayne Falterman, M.D. and the Louisiana Patient’s Compensation Fund alleging deviation from the standard of care resulting in severe and permanent brain damage to Tai Landry. At birth, Tai Landry was diagnosed with Pierre Robin Sequence, which is characterized by micrognathia (a small jaw), Glossoptosis (a tendency for the base of the tongue to fall backwards into the throat), and airway obstruction. Tai Landry suffered from multiple symptoms including apnea and bradycardia. In pre-trial motions and at trial the other Defendants aligned with the Plaintiffs to direct liability to PSA. Post-trail motions are now pending.
