Over the past few years, we have seen more and more legislation passed providing some level of protection against discrimination on the basis of gender identity or gender expression. In its Bostock opinion in 2020, the Supreme Court held that Title VII of the Civil Rights Act protects homosexual and transgender employees against workplace discrimination. However, only 14 states and the District of Columbia have legislation protecting the workplace, and several jurisdictions have revived anti-trans legislation in other areas. Transgender attorneys face some unique challenges in realizing full workplace participation.
In this discussion, we will examine how transgender rights are sometimes viewed separate from the rights of other underrepresented groups and how this impacts our transgender colleagues in the workplace and beyond. Our panel will discuss how racial, ethnic, and gender stereotypes affect the hiring, promotion, and retention of transgender attorneys in private law firms and businesses. Our panelists will share personal stories and concrete action items that will include steps you can take to educate yourself on the unique daily struggles transgender attorneys face in the workspace, cultivate more accepting, welcoming social spaces for transgender people, and end social inequality.
