How to Regain Control of a Witness Who Has Lost It

This is a reprisal of the program presented at the 2022 Midyear Meeting. Too often we prepare a witness for trial or deposition, only to see them begin to lose their way—or even fall apart--once in the witness chair. This program will use specific examples to show the ways a witness loses it, and present strategies for helping the witness regain control and to cure stumbles without doing further damage. This program will focus on diagnosing the issues ahead of time to better help you prepare the witness for the inevitable strain of testifying at trial or a deposition.

Key Takeaways:

  1. Diagnosing the type of witness and problems they are likely to encounter before testifying
  2. Ways to empower a witness to perform well and regain composure
  3. How and when (and if) to ameliorate the witness when they stumble
