The Changing Landscape of Washington’s Equal Pay Act: Court Decisions and Legislative Updates

There are a flurry of Equal Pay class action suits making their way through Washington courts. This year there was legislative action, a Washington State Supreme Court decision, and active communication among the defense bar about how to address this law that has put employers who were in violation from January 1, 2023 until July 27, 2025 subject to a $5,000 per penalty violation for failing to post pay ranges and benefits on job postings. Prior to the 2025 amendment, there was no period for cure or other remedial measures in the law. 

Whether courts enforce the strict $5,000 per penalty violation remains unclear. We will advise on the developments and defense strategies.
