The Role of the European Court of Justice in Developing a Pro-Plaintiff Product Liability Case Law
The European Court of Justice has rendered a number of landmark decisions in the product liability sphere the past couple of years which are qualified by most as being "pro-plaintiff" decisions. In this respect, it has condemned both companies, but also Member States, in order to force the latter to adopt more stringent legislation to protect the population against the negative impact of product manufacturing and placement on the market. These States are reacting quite differently depending on their culture and the current customs and practices of their Courts. This Webinar will aim at providing an overview of what needs to be known about the European Court's case law, the approach of a select number of Member States, and a view as to how the United Kingdom is dealing with this case law since Brexit.
