J. Randolph Bibb, Jr., Robert F. Chapski, and William J. Conroy Obtain Full Defense Verdict in Bambino v. Toyota Motor Corp.

On June 28, 2013, IADC members J. Randolph Bibb, Jr., and Robert F. Chapski of Lewis, King, Krieg & Waldrop, P.C., Nashville, TN, and William J. Conroy of Campbell Campbell Edwards & Conroy, Wayne, PA, obtained a full defense verdict in Philadelphia state court in Bambino v. Toyota Motor Corp., a matter involving the alleged unintended acceleration of a 2007 Toyota RAV4. Plaintiff Diane Bambino claimed that after she accidentally backed into a tree on her property, her vehicle then malfunctioned and accelerated forward causing her to crash into a second tree head-on. Mrs. Bambino sustained serious internal injuries in the crash, and her two grandchildren buckled in child restraints in the rear seat were also injured. Toyota argued that the unfortunate crash was the result of Mrs. Bambino mistakenly applying the accelerator pedal instead of the brake pedal. Despite the Bambinos discarding the vehicle after the wreck, Toyota demonstrated that physical evidence from insurance photographs of the vehicle, the scene, and the acceleration and braking capacity of the vehicle did not support Mrs. Bambino's recollection of the events. After the two-week trial, the Philadelphia jury deliberated for little more than an hour before finding that the RAV4 was not defective.
