James A. King Obtains Defense Verdict for Egg Farm

IADC member Jim King with the Columbus, Ohio law firm of Porter, Wright, Morris & Arthur LLP led a team that obtained a complete defense verdict for one of the nation’s largest egg farms in a major antitrust class action trial in federal court in Philadelphia. The class alleged that the nation’s largest egg producers violated Section 1 of the Sherman Act by engaging in a conspiracy to raise shell egg prices through supply reductions. The class sought more than $1 billion in damages, which could have resulted in a $3 billion verdict after trebling. After 27 days of trial, and nearly 7 days of deliberations, on June 14, a jury returned a complete defense verdict in the egg producer’s favor. The case is In re: Processed Egg Products Antitrust Litigation, Case No. 2:08-md-02002, U.S. District Court for the Eastern District of Pennsylvania.
