Mary Wells Successfully Defends Colorado Town In Federal Court Jury Trial

IADC member Mary Wells of Wells Anderson & Race, LLC defended a small Colorado town and its Town Attorney in a federal court jury trial and prevailed against a developer which sues claiming the Town breached an airport development lease. The self-acknowledged "mover and shaker" plaintiff had failed to comply with an essential term of the lease - to present a comprehensive development plan for the airport property. The plan was the primary consideration that the Town was to receive in return for leasing acreage to the developer for 49 years, rent free. The developer claimed that the Town had breached the lease by rejecting its "plan" and that the Town has violated its rights to due process. The developer sought $8 million from the Town which had no resources to satisfy any judgment.
