Matt Wojcik Wins Defense Verdict in Medical Malpractice Trial

On May 23, 2018, IADC member Matt Wojcik of Bullivant Houser Bailey in Seattle obtained a defense verdict on behalf of a podiatric surgeon in a medical malpractice case. The case was tried over the course of two and a half weeks in the Kitsap County Superior Court before Judge Kevin Hull. The case involved a 65 year old patient who underwent amputation of two toes in separate surgeries following MRI confirmation of osteomyelitis. Plaintiff contested the presence of osteomyelitis in one of the toes and contended that he was under the impression that the second toe was to be biopsied rather than amputated (despite both consent forms identifying “amputation” as the intended procedure). Plaintiff contended that the amputations resulted in chronic pain and functional deficits. Plaintiff asked the jury to return a verdict between $400,000 – $600,000.
