M.C. Sungaila and David Axelrad received a defense verdict in a benzene case for Shell, Chevron, and Unocal. The court rejected the application of the "increased risk" causation standard used in asbestos cases in a toxic tort case where the ability of a chemical to cause the kind of harm claimed is disputed. (This issue is a developing one in California, and hotly contested between the plaintiff's and defense bars.) Ms. Sungaila argued the case and was the lead on the appellate brief.
