Michael J. Farrell and Erik W. Legg, both of Farrell, White & Legg PLLC, successfully defended against a Petition for a Writ of Prohibition filed against their pharmaceutical client in the Supreme Court of Appeals of West Virginia. The Petition arose from the successful prosecution of a Motion to Dismiss before the West Virginia Mass Litigation Panel of twenty product liability and negligence cases based on forum non conveniens pursuant to W. Va. Code § 56-1-1a. The opinion by Supreme Court of Appeals was delivered by a 3-2 vote of the Justices.
