Molly Craig Obtained Defense Verdict in Charleston County, South Carolina

IADC member, Molly Craig, and Chilton Grace Simmons, recently obtained a defense verdict in Charleston County, South Carolina. The Plaintiff sued an emergency medicine physician and physician’s assistant alleging they failed to properly diagnose her hand injury during three visits to the emergency department resulting in permanent loss of motion and permanent damage. Plaintiff sued for actual damages, medical specials, lost wages, and pain and suffering. The Defendants proved the injury was not diagnosable at the time of treatment and argued the Plaintiff was comparatively negligent by failing to return for follow-up, as directed. After a four day trial, the jury deliberated for one hour and returned a defense verdict finding the Defendants did not breach the standard of care.
