  • Courtroom Success: Scott Marrs

    IADC member Scott Marrs recently won a major trademark case for Hollywood movie studios in what turned out to be a real dog fight. Rin Tin Tin, the famous German Shepherd puppy plucked from the battlefields of France by a United States soldier during World War I, was the subject of his clients’ recently released children’s movie, Finding Rin Tin Tin. A Texas German Shepherd dog breeding company immediately sued the studios for trademark infringement, claiming to own exclusive rights to the trademark “Rin Tin Tin”, and seeking all profits, along with the destruction of all movie discs. A Houston, Texas federal court recently ruled in favor of the studios, holding that their use of the name Rin Tin Tin in the body and title of the movie was a “fair use” and protected under the First Amendment​

  • Courtroom Success: Kevin C. Schiferl

    IADC member Kevin C. Schiferl and Richelle M. Harris successfully represented Iowa Pipeline Associate, Inc. (f/k/a KLP Construction Company, Inc.), SEMCO Construction Parent Company and SEMCO Iowa Construction Company in a lawsuit which had a nearly five year long life and multiple claims, cross-claims, and third-party claims. A District Judge for the Southern District of Indiana returned a 38 page written opinion entering a judgment in favor of the defendants in a dispute arising out of a dual fatality, natural gas explosion.

  • Courtroom Success: Saul Wilenksy and Carl J. Schaerf

    IADC members Saul Wilensky and Carl J. Schaerf, together with associate Allison N. Fihma of Schnader Harrison Segal & Lewis were successful in a motion for Summary Judgment in Cuntan v. Hitachi. The lawsuit involves a Romanian immigrant, who had been employed as a handyman and construction worker who alleged that a Hitachi circular power saw moved across the ground with its blade exposed and severely cut his hand. In analyzing all causes of action, including negligence, strict liability, breach of warranty, product design defect, failure and/or inadequate warnings, the Court ruled in Hitachi’s favor.
