  • Victory Aided by IADC’s First U.S. Supreme Court Amicus Brief

    The U.S. Supreme Court offered an 8-1 ruling in support of Shell in Shell Oil Company v. United States of America – a case for which the IADC offered amicus support. Thank you to Lauren Harris, MC Sungaila and the Amicus Committee for their efforts on the brief. The U.S. Supreme Court overturned the 9th Circuit ruling which concluded that a manufacturer of a commercially viable product was liable as an "arranger for disposal" when the party to whom it sold the product spilled it during its use. The 9th Circuit opinion effectively made a product manufacturer the perpetual environmental insurer for misuse or improper disposal by third parties.

  • Courtroom Success: Tamela J. White

    On March 13, 2009, member Tamela J. White of Farrell, Farrell & Farrell and associate Marvin “Chip” Capehart, II defended a general surgeon in a medical malpractice case in the Circuit Court of Logan County, West Virginia. The case involved an alleged failure to timely diagnose and treat a ruptured appendix, which failure, in turn, led to the formation of a clot of the femoral artery. Following a one week trial, the jury returned a defense verdict in favor of the surgeon.
