Timothy Coughlin Awarded Summary Judgment

Following a case argued in front of the Ohio Supreme Court by lead counsel Timothy J. Coughlin, Valentine v. Conrad, 110 Ohio St. 3d 42 (2006), BASF Corporation (“BASF”) was awarded summary judgment last week when the court ruled that plaintiffs Larry and Margaret Cooper could not establish that Mrs. Cooper’s hypothyroidism was caused by exposure to BASF’s product, the termiticide Termidor SC, where there was no reported case of this product ever causing hypothyroidism or thyroid abnormalities of any kind in humans in the published medical or scientific literature.

Jack McCowan Obtained Summary Judgment on Behalf of Major Multinational Corporation

On the eve of a trial expected to last six months and in the face of a $20 million demand, IADC member Jack McCowan and Gery Zacher of Gordon & Rees obtained summary judgment on behalf of a major multinational corporation alleged to be responsible for perchloroethylene (PCE) contamination in groundwater near a former industrial site in Orange County.

The Arkansas Supreme Court, in a unanimous decision, reversed a $2.5 million judgment and dismissed a complaint in a products-liability case in which Quattlebaum, Grooms, Tull & Burrow PLLC, working with Wilson, Elser, Moskowitz, Edelman & Dicker LLP, represented a defendant on appeal.
