Paul Lefebvre, IADC Board Member and partner at Hanotiau & van den Berg, acted on behalf of a retired president of a Court of First Instance who had been elected into the Belgian Superior Council of Justice. The President was prosecuted for an alleged criminal offense for which she was eventually declared not guilty by the Court of Appeal of Brussels.
Pending those criminal proceedings, the president had been suspended in her functions by the Superior Council of Justice. Under Belgian law there existed no recourse against this decision other than before the Council itself which confirmed its decision. A recourse was introduced before the European Court of Human Rights which condemned Belgium.
