Peter and his team at the Canadian national law firm of Fasken Martineau DuMoulin LLP, recently achieved a class action victory for their clients, FCA US and FCA Canada Inc. On September 6, 2023, a judge of the Saskatchewan Court of King’s Bench dismissed the plaintiff’s application for certification of a national class action against FCA in Tress v. FCA US LLC and FCA Canada Inc., a proposed class action alleging the presence of “defeat devices” in various models of diesel fuel vehicles. In short, the judge agreed with the defence submissions that the plaintiff had failed to adduce any evidence that he or any other proposed class member had suffered any legally-compensable harm, and consequently a class action is not a “preferable procedure” for the resolution of any common issues in this action.
