IADC members R. Bruce Barze, Jr. and Matthew Todd Lowther, partners at Barze Taylor Noles Lowther LLC, obtained a defense verdict in Jefferson County Circuit Court after a seven-day trial in a wrongful death case arising from a 2021 train derailment at the ACIPCO main rail yard in Birmingham, Alabama. During closing arguments, opposing counsel from Beasley Allen asked the jury to award $10-15 million. After considering the evidence, the jury returned a verdict in favor of BTNL’s client, Morrow Railroad Builders, on both the negligence and wantonness claims.
