Rachel E. Yarch Obtains Favorable Decision in Hoppe v. Lewis University Case

Rachel E. Yarch, partner at Kopon Airdo, LLC in Chicago, obtains a unanimous decision from the Seventh Circuit affirming the granting of summary judgment in favor of her client.  Specifically, the Court held that the University complied with ADA by offering professor reasonable accommodation for her adjustment disorder. 

The Court further determined that the university participated in good faith in the informal interactive process with a tenured professor and offered a reasonable accommodation for her clinically-diagnosed adjustment disorder. Thus, the university did not violate the Americans with Disabilities Act (ADA). 

Finally, the court held that the university took reasonable steps to offer three different office locations to the professor, despite her lack of cooperation during the interactive process by failing to provide information that the university requested. Instead, the professor submitted a letter from her physician that lacked specific details about the necessary steps to provide a reasonable accommodation.
