Randal H. Sellers and W. Christian Hines Obtain Favorable Defense Verdict for Family Medicine Physician

Randal H. Sellers and W. Christian Hines, of Starnes Davis Florie LLP, obtained a defense verdict on December 12, 2013 in favor of a family medicine physician in a wrongful death action. The patient died on May 17, 2006, with an autopsy revealing multiple gastrointestinal abscesses and a perforated sigmoid colon. The plaintiff alleged that the family medicine physician, who saw the decedent on May 16, 2006, failed to diagnose diverticulitis, peritonitis and sepsis. An ER physician who saw the patient on May 12, 2006 was also sued. After an eight day trial in the Circuit Court of Baldwin County Alabama involving thirteen witnesses, eight of whom where physicians, the jury returned verdicts in favor of both physicians.
